Calrification for concerned owners
The current committee would like to clarify the following points:
1. A full audit of the Kingston Quay accounts are in the process of being completed by Fern Associates and will be available on this web site and will be posted to all owners. Owners should be reminded that they can, with prior arrangement, view invoices in the concierge office. There is a charge to do this of £5 per invoice. If any owner requires a copy of an invoice the cost is £25 per invoice.
2. The Bank account held by A&K Property Management for Kingston Quay owners is insured against fraud and bankruptcy of A&K. The committee can view the bank account at any time. If a new property manager/factor is voted in, the balance of the bank account would have to be returned to the individual owners who have paid in: it CANNOT be passed onto a new factor.
3. DM Hall (Glasgow) Surveyors have confirmed that at no time have they refused survey reports for mortgages at Kingston Quay also RBS and Barclays have stated that Kingston Quay has never been put on a blacklist for mortgages.
4. An AGM will be held on Friday 26th March 2010, you will be advised of the details shortly.
5. The meeting of 27th November was arranged by a number of individuals who did not follow the correct procedure as outlined in the Deed of Conditions. The legal standing of the meeting is fundamentally flawed, because of this and other irregularities already explained. Owners can therefore rest assured that under no circumstances will owners' funds be used to finance this meeting, in particular the legal costs which were incurred by direct instructions from a minority of individual owners. Although it has been suggested that votes were taken on a number of motions, no results of any votes have been provided.
6. Owners' personal details are held by the Property Manager and will not be divulged to unauthorised persons. A comment was made at the meeting of 27th November suggesting that A&K’s licence to hold the database of owners details had expired. Please see attachment which confirms it is in fact current. The data CANNOT be passed on to a new factor, the present property manager/factor would have to write to all owners to ask their permission to pass on their details.
