WATER INGRESS REPORT

27 January 2010

Dear Owners/Residents

ROOF SURVEY AND REPAIRS
I would like to inform you that A&K along with the Kingston Quay Residents Committee have successfully negotiated a deal with BARRATT to conduct a survey, and where required repairs to the roof. This will be followed by further negotiations to respond to other repairs required.
As you know this has been a long battle and all parties involved should be complemented for their commitment to Kingston Quay

GARAGE REPAIRS
It should also be noted that Morris and Spottiswood are conducting repairs within Kingston Quay’s car park to repair water ingress. In order for this work to be completed properly, Morris and Spottiswood staff will require entry to all flats to update water cisterns. The works being conducted are part of a 3-month project, which is now in its final stage. All owners will receive an updated report upon completion.
Again, this outcome has been achieved through the hard work and commitment of the committee, A&K and NHBC.

WATER INGRESS
As a result of this hard work we are now moving on to deal with water ingress problems in owner’s flats.
A&K now require all owners to inform the Property Manager (Alex McDivitt) if they currently have water ingress or have had water ingress over the last 2 years.
BARRATT will require this information before any negotiations or works can start.
Please include any costs involved (invoices will be requested at a later date).

Dear Owners,

You may be aware that the Kingston Quay Residents Association AGM will be held on Friday 26th March 2010. You will shortly receive a formal invitation to this meeting.

The meeting will be chaired by Mrs Debra Clapham of Claphams Solicitors,1B Helena House, Busby Road, Clarkston, Glasgow G76 7RA. As well as being a solicitor, Mrs Clapham is a lecturer in property conveyancing law at Glasgow Caledonian University and a senior tutor in conveyancing at the University of Glasgow.

In preparation for the forthcoming meeting we will require your assistance on the following matters.

1. ELECTION OF RESIDENTS ASSOCIATION MEMBERS
Any owner who wishes to put their name forward for a position on the Residents Association committee should notify Mrs Debra Clapham by post at the above address or by e-mail to, debralawagents@davidcclapham.co.uk stating which position you would like to apply for and the reasons you seek appointment. This will assist those proprietors who are unable to attend the meeting and vote instead by postal ballot. A brief statement is all that is required.
The positions available within the committee are;
• Chairman
• Treasurer
• Secretary
• 4 x Ordinary Member
This should reach Debra Clapham no later than Friday 19th February 2010. .
Your committee is a working committee. All members are required to take on duties and attend at least 75% of meetings. All committee members are required to be fully up to date with their factoring fees.


2. POINTS FOR THE AGENDA
Please inform Debra Clapham of any business you feel should be included in the agenda for discussion, together with your contact details. This should also reach Debra Clapham in writing no later than Friday 19th February 2010.

Anyone who cannot attend the meeting in person will be asked to vote by post in advance of the meeting. Information on any issues to be voted on will, therefore, be distributed in advance. The committee are happy as far as possible to clarify any matter within their competence by telephone or e-mail.

Calrification for concerned owners

The current committee would like to clarify the following points:

1. A full audit of the Kingston Quay accounts are in the process of being completed by Fern Associates and will be available on this web site and will be posted to all owners. Owners should be reminded that they can, with prior arrangement, view invoices in the concierge office. There is a charge to do this of £5 per invoice. If any owner requires a copy of an invoice the cost is £25 per invoice.

2. The Bank account held by A&K Property Management for Kingston Quay owners is insured against fraud and bankruptcy of A&K. The committee can view the bank account at any time. If a new property manager/factor is voted in, the balance of the bank account would have to be returned to the individual owners who have paid in: it CANNOT be passed onto a new factor.

3. DM Hall (Glasgow) Surveyors have confirmed that at no time have they refused survey reports for mortgages at Kingston Quay also RBS and Barclays have stated that Kingston Quay has never been put on a blacklist for mortgages.

4. An AGM will be held on Friday 26th March 2010, you will be advised of the details shortly.

5. The meeting of 27th November was arranged by a number of individuals who did not follow the correct procedure as outlined in the Deed of Conditions. The legal standing of the meeting is fundamentally flawed, because of this and other irregularities already explained. Owners can therefore rest assured that under no circumstances will owners' funds be used to finance this meeting, in particular the legal costs which were incurred by direct instructions from a minority of individual owners. Although it has been suggested that votes were taken on a number of motions, no results of any votes have been provided.

6. Owners' personal details are held by the Property Manager and will not be divulged to unauthorised persons. A comment was made at the meeting of 27th November suggesting that A&K’s licence to hold the database of owners details had expired. Please see attachment which confirms it is in fact current. The data CANNOT be passed on to a new factor, the present property manager/factor would have to write to all owners to ask their permission to pass on their details.
